Not seen it mentioned anywhere so apologies if I’ve missed it. GC said to the press on Thursday that Will is still under contract with the club, still under investigations and still suspended. He called last week and asked for permission to play for Accrington which was granted. GC said he has the opportunity to leave the club, and is free to leave if he wishes. He also mentioned employment laws being as they are, he can’t do what he would like to do. I think you can read between the lines there.

Surely if we’re to believe what ‘those in the know’ have put on here he could get sacked for gross misconduct?!

Maybe the club don’t fancy defending a lawsuit.

He probably could, but GC used the phrase "the investigation is still ongoing", so I assume we can't go down that route until he is charged.
My reading between the lines is that he has been told that if he can find himself another club we won't stand in his way, and it would look better if he didn't have a sacking on his CV.

Over the weekend I heard what happened from someone who was there, a member of staff more specifically... So figured I'd share with you all. Tomlinson, who was in a large group, held a chair up in an agressive manner to a member of staff when they were told they couldn't all be together due to current social distancing guidelines. Upon leaving, their group all started to fight amongst themselves and when the police arrived, Tomlinson spat in the face of an officer. He was then arrested, he was the only one to have been so. So, there you have it.

I used to work in this area of employment law. Granted I've been retired 10 years but the same principles apply. An employer does NOT have to wait the outcome of a police investigation, court case, guilty verdict, before taking action. They conduct their own investigation. If they have reasonable belief (not court related beyond reasonable doubt) they can begin disciplinary action. If the offence is serious enough they can dismiss. Even if later no charges are brought or the person is found not guilty in court, the dismissal can still be fair. Reasonable belief after a reasonable investigation (not a Haslam one) and a reasonable response is all the employment law courts require.
