Assault

Jacob Mellis might do a bit of plea bargaining. He might offer to plead guilty to assault if GBH and Affray charges are dropped and then hope for a non-custodial sentence. He's looking at a custodial sentence if found guilty of GBH or affray.

Your right. I had clicked on the wrong GBH link. Probably going to be Category 1 or 2 again due to serious harm inflicted.

No. I don’t practise criminal law (its not my area) and never have but I have studied it many years ago and I do know that sentencing depends on (a) tariff (b) severity of the offence (and context within tariff) (c) previous offences (and similarity) (d) guilty plea (e) mitigation (f) sentencing report(s) (g) victim statement (h) aggravating factors and (i) not stated, but side of bed the judge got out of that day.
There’s certain offences that carry mandatory jail terms (there’s actually very few) and then there’s a whole range of discretionary sentencing. He might go to jail and he might not.
The outcome depends on a whole range of factors where you don’t (and I don’t) have the facts. Your statement suggested a level of confidence that I don’t believe you can have, hence I questioned it.
You might be right (and he may well get such a sentence) but you can’t be sure.
