The only credit that you can give to Donohue is that he has had the grace to plead guilty and saved the victim the trauma of a trial. If you are cynical you could argue he has only done it to get a shorter sentence, which may be correct.

I think he will have to pack a toothbrush.

Where does he mention Mellis.As far as I can see he clearly only refers to Donahue but you somehow manage to put a twist on it .

The Sentencing Guidelines are as follows.

GBH
Category depends on culpability and amount of harm caused.

Category 1: 12 years’ custody. Range: 9 – 16 years’ custody
Category 2: 6 years’ custody. Range 5 – 9 years’ custody
Category 3: 4 years’ custody. Range 3 – 5 years’ custody

Maximum one third reduction for guilty plea

Affray
I would say it is a Category 1 offence (serious physical injury) and Culpability will be A or B.

Culpability A: Starting point 2 years’ custody. Category range 1 year 6 months – 2 years 9 months’ custody
Culpability B: Starting point 1 year’s custody. Category range 26 weeks’ – 1 year 6 months’ custody


Assault
Maximum: 2 years’ custody

Starting point: community orders

Jacob Mellis might do a bit of plea bargaining. He might offer to plead guilty to assault if GBH and Affray charges are dropped and then hope for a non-custodial sentence. He's looking at a custodial sentence if found guilty of GBH or affray.

TTP I don’t believe your GBH guidelines are correct. That’s for GBH with intent. ‘Standard’ GBH carries a lower tariff.

Obviously not. If you would care to read it again, I make no reference to Jakab Mellis as he has pleaded not guilty and I am not judging him as I know no facts.

Donahue has pleaded guilty so I think it acceptable to speculate what his punishment may be as his guilt is no longer in doubt. As I stated I think it inevitable he will receive a custodial sentence hence my comment about his toothbrush.

Your right. I had clicked on the wrong GBH link. Probably going to be Category 1 or 2 again due to serious harm inflicted.

Remember they can suspend the sentence too so not necessarily proper jail time.
